Terms and Conditions of Supply of Goods by Bazi Jewels Limited

Introduction 

These terms and conditions (together with our privacy notice, which can be found on our website at https://bazijewels.com/pages/privacy-policy (“Website”), (“Terms and Conditions”) confirm the basis on which we supply any of our products (“Products”) or provide any services shown or described on our Website, to you.

Please read these Terms and Conditions carefully before placing your order. By ordering any Products you agree to be bound by our Terms and Conditions.

About you

By placing an order through our Website you agree and warrant that you are:

- legally capable of entering into binding contracts;

- at least 18 years of age; and

- you are purchasing as a consumer.

Website Content and Amendments

We make all reasonable efforts to ensure that the images of our Products, the prices displayed, and any descriptions of our Products, or any services we may offer, is accurate.

All images are for illustrative purposes only and any measurements or dimensions displayed are approximate. Products and packaging received may vary slightly from the images shown.

In terms of the colour of Products, we accept no liability for colours not matching the colour displayed on your viewing monitor or screen as this is dependent on the quality and abilities of your monitor or screen.

We reserve the right to make changes to the Website and to these Terms and Conditions at any time and without any notice or warning. Such changes may include, but are not limited to:

- additions, amendments, modifications or removal, to any or all of these Terms and Conditions;

- additions, amendments, modifications or removal of any promotions, offers or discounts;

- additions, amendments, modifications or removal of Products, product descriptions, product information or any other Website content;

- temporary or permanent withdrawal of the Website.

Placing an Order

After placing your order (“Order”) you will receive an email from us acknowledging that we have received your Order and confirming the details of your Order. 

Our email acknowledgment is not our acceptance of your Order. Your Order will only be accepted once we are satisfied that:

  1. the Product is in stock and available for delivery;
  2. the details of the Product are correct;
  3. payment has been approved and processed. 

We will confirm our acceptance of your Order by sending an email confirming that the Product has been dispatched (“Dispatch Email). The contract (“Contract”) between us will be formed when we send the Dispatch Email.

Should there be any conflict between these Terms and Conditions and any term of the Order then the Order will take priority.

In the event you have paid for a Product and we are unable to supply or deliver the Product to you we shall notify you by email and provide you with a full refund of the purchase price paid along with any delivery costs paid. 

Refunds and Returns

Whilst we do not accept returns, we are happy to exchange any item within 7 days of delivery. Unfortunately, we are unable to offer exchange on earrings.

Sale items are not eligible for refund or exchange, unless the item in question is faulty.

In the case the goods are faulty: you must inform us by email to info@bazijewels.com including all details of the order and defect or other reason for return.

The Goods must be returned to us as soon as any defect is discovered.

So far as possible, Goods should be returned: with both goods and all packaging as far as possible in their original condition; securely wrapped; including our delivery slip; marked as ‘Return’ (external packaging); at your risk and cost.

We will only accept returns provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you. We will not accept exchanges for any non-faulty items that have been worn and/or tags removed.

All exchanges will be processed with 14 working days from the date we receive the Product back from you unless we advise otherwise in writing.

Delivery

Goods will be dispatched within 1-2 working days. We ship all orders through registered, recorded delivery, and are happy to help with any urgent delivery requests. 

You must ensure that someone is present to accept delivery.

We do not cover customs and duty payments for orders outside the UK.

Goods are sent at our risk until signed for by you or by any other person at the address you have given to us.

We will send you a message by email to tell you when we have despatched your order.

Delivery costs are additional to the price of any Product.

Price and Payment 

The Price of Products will be as shown on our Website, except where there is an obvious error.

 We reserve the right to make changes to our prices at any time. Any changes will not affect the price of Products where a Dispatch Email has been sent prior to a price change being made.

Our prices include VAT but are exclusive of any delivery costs. In the event the VAT rate changes between the date of your Order and the date we take payment from you the amount of VAT which is payable will be automatically adjusted.

In the event it comes to our attention that a Product displayed on our Website is incorrectly priced, where the correct price is lower than the price shown on our Website, we shall charge the lower amount. Where the Product’s correct price is higher than the price shown on the Website, we shall contact you to ask whether you wish to proceed with the purchase at the correct, higher price, or we shall reject your Order and notify you that your Order has been rejected.

Payment for your Product should be paid by credit or debit card in advance. Your card will be charged once the Product has been dispatched for delivery to you.

Ownership of the Product will pass to you once we have received payment in full of all sums due. Payment in full includes any applicable delivery charges that apply.

Our Liability

Our liability to you for any losses that you suffer as a result of us breaching these Terms and Conditions or our negligence is limited to the purchase price of the Product and any reasonably foreseeable losses.

Our liability does not exclude or limit:

- death or personal injury caused by our negligence;

- fraud or fraudulent misrepresentation;

- defective products under the Consumer Protection Act 1987;

- breach of the implied terms of the Consumer Rights Act 2015 (namely satisfactory quality, fitness for purpose, description, installation); and

- breach of the implied terms of the Sale of Goods Act 1979 (namely Section 12 relating to title and quiet possession).

 Events outside of our control

We shall not be responsible for any failure to perform, or a delay in the performance of any of our obligations under these Terms and Conditions which is due to an event happening which is outside of our control (“Event”).

An Event beyond our control includes any event or act beyond our reasonable control, including, but not limited to, strikes, lock outs or other industrial action, civil commotion, riots, invasion, terrorist attack or suspected terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, impossibility of the use of shipping, railways, aircraft or other means of public or private transport, power failure, or failure of the use of public or private telecommunications networks,

Should an Event arise which affects our performance then:

- we shall contact you as soon as possible;

- the time for performance under our contract and our obligations under these Terms and Conditions will be suspended for the duration that the Event continues;

- if your delivery date is affected by an Event then we shall contact you with an updated delivery date once the Event is over;

- where an Event continues for more than 6 weeks you have the right to cancel your contract in accordance with Clause. Should you wish to cancel your Contract then please follow the process set out above.

- we reserve the right to cancel your Contract where an Event continues for longer than eight weeks. 

General 

We may assign our rights and obligations under these Terms and Conditions to any other person. In the event such an assignment arises then we shall inform you in writing by post or email.

You cannot transfer your rights and obligations under these Terms and Conditions to any other person without our written approval.

The contract shall be between you and us. No third party shall have any right to enforce any terms.

In the event any provision of these Terms and Conditions is deemed to be invalid, or unenforceable for any reason then that provision shall be struck out and the remaining provisions shall remain valid and enforceable.

Our failure to insist that you perform any of your obligations under these Terms and Conditions or to enforce our rights against you, or delay in doing so, does not mean that our rights against you have been waived and does not mean that you need not comply with those obligations. Should we choose to waive your default then we will confirm this in writing. Our decision to waive your default does not apply to any future defaults that may arise.

These Terms and Conditions and our Privacy Notice represent the entire agreement between us and supersede all other negotiations, previous agreements, correspondence, promises, assurances, warranties, representations, understandings or discussions between us whether written or oral, relating to its subject matter.

These Terms and Conditions and the arrangement agreed between us shall be governed by the exclusive jurisdiction of the Courts of England and Wales and the laws from time to time in force.
